PART 1 — GENERAL TERMS & CONDITIONS 

1. Introduction

Thank you for considering Green N Clean for your property maintenance, cleaning, restoration, gardening and pest-control requirements. These Terms apply to all services supplied by Green N Clean (2015) Limited unless the quotation or written agreement states otherwise. 

2. Acceptance

By accepting a quotation in writing, verbally or electronically, booking a service, instructing Green N Clean to proceed, or allowing our personnel to commence work, the Client confirms acceptance of these Terms and the applicable service-specific terms. 

3. Client Responsibilities 

The Client must provide safe and reasonable access; secure children and pets; remove or protect fragile, valuable and personal items; disclose known hazards, defects, asbestos, water leaks and sensitive surfaces; and obtain any required owner, landlord, body corporate, council or other approvals. 

4. Preparation 

Where the Client is required to prepare the property, failure to do so may result in incomplete work, delay, rescheduling or additional labour. Green N Clean is not responsible for items left in work areas where reasonable precautions could not be taken. 

5. Quotations

Quotes are based on the information available at the time. Hidden, inaccessible or materially different conditions may require additional labour, materials, equipment, specialist contractors or revised timing. Where reasonably practicable, Green N Clean will discuss material variations before proceeding. 

6. Minimum Labour and Equipment 

Unless otherwise quoted, a minimum two-hour labour charge may apply. EWP/MEWP/cherry-picker, specialist access equipment, after-hours attendance, emergency mobilisation, disposal, additional materials and specialist contractors may incur additional charges where stated or reasonably required. 

7. Working at Heights 

Roof, ladder, EWP/MEWP and other height work is subject to a site safety assessment. Work may be postponed or stopped because of wind, rain, lightning, slippery surfaces, fragile roofing, unsafe ground, electrical hazards or unsuitable access. 

8. Weather and Events Outside 

Control Exterior, gardening and restoration work may be affected by weather, flooding, storms, power failure, unsafe conditions, equipment failure despite reasonable maintenance, supply disruption or other circumstances outside reasonable control. Green N Clean may reschedule affected work. 

9. Variations 

Additional work requested by the Client or required because site conditions differ from the quotation may be charged at the agreed or applicable rate. Material variations will be communicated where reasonably practicable. 

10. Cancellation 

Reasonable notice should be provided for cancellation or rescheduling. A $75 attendance/cancellation charge may apply where the Client cancels without reasonable notice, fails to provide access or prevents commencement. 11. Payment 

Payment is due by the invoice due date. Unless otherwise stated, payment may be due by the 20th of the following month or within 14 days. Payment may be made by bank transfer, cash or accepted card/payment method. 

12. Overdue Accounts 

Overdue invoices may incur interest at 18% per annum from the due date and reasonable debtrecovery/legal costs to the extent permitted by law. Future services may be suspended while an account remains overdue. 

13. Insurance Claims 

Where work relates to an insurance claim, the Client remains responsible for Green N Clean’s invoice unless Green N Clean expressly agrees otherwise in writing. Insurance approval, assessment, delay, decline or reimbursement does not automatically release the Client from payment. Green N Clean does not guarantee that an insurer will approve or reimburse a particular amount. 

14. Photographs, Video and Reports 

Green N Clean may take photographs, videos, moisture readings, measurements and service notes for work records, reporting, quality control, insurance documentation, dispute resolution and internal records. Unless expressly stated, reports are not structural, engineering, legal, forensic, building or insurance-coverage certifications. 

15. Pre-existing and Concealed Conditions 

Cleaning, washing, restoration, gardening and other services may reveal pre-existing defects such as rot, corrosion, failed sealants, defective joinery, damaged roofing, weak surfaces, hidden water damage, defective drainage or concealed services. Green N Clean is not responsible for pre-existing conditions, subject to rights and liabilities that cannot lawfully be excluded. 

16. Safety and Stop-Work 

Green N Clean may refuse, suspend or stop work where conditions are unsafe, a serious hazard is identified, access is inadequate, required controls are unavailable or the Client’s instructions create an unreasonable risk. Additional attendance or specialist costs caused by Client-controlled hazards may be charged where permitted. 

17. Liability 

Green N Clean will perform services with reasonable care and skill as required by law. To the maximum extent permitted by law, Green N Clean is not liable for indirect, consequential, special or economic loss, loss of profit, business interruption, pre-existing or latent defects, concealed conditions, Client instructions, undisclosed hazards or circumstances outside reasonable control. Subject to mandatory legal rights, liability for a claim arising from a service is limited to the amount paid or payable for that particular service. 

18. Statutory Rights 

Nothing in these Terms excludes or limits any right, guarantee or liability that cannot lawfully be excluded or limited. Where both parties are in trade and statutory requirements are satisfied, the parties may contract out of the Consumer Guarantees Act to the extent permitted by law; any such contractingout should be expressly documented. 

19. Privacy 

Green N Clean may collect, retain and use client information reasonably required for service delivery, communication, invoicing, account management, safety, debt recovery, records and lawful marketing. Clients may request correction of personal information subject to applicable law. 

20. Governing Law 

These Terms are governed by New Zealand law. Disputes may be dealt with by the appropriate New Zealand court, tribunal, mediation or other forum with jurisdiction. 

SERVICE 1 — EXTERIOR HOUSE WASHING / WATERBLASTING 

Scope 

Cleaning is limited to the exterior surfaces specifically listed in the quotation. Unless expressly quoted, roofs, gutters, decks, pergolas, detached garages, sheds, fences, retaining walls, driveways, paths, interior areas and specialist surfaces are excluded. 

Water Ingress 

The Client must close windows and doors and disclose known leaks or weathertightness defects. Green N Clean is not responsible for water entering through failed seals, damaged cladding, vents, penetrations, open windows, defective joinery or other pre-existing defects, subject to mandatory legal rights. 

Surface Damage 

Washing may expose loose paint, chalking (dull window joinery), brittle coatings, rotten timber, cracked render, damaged cladding, failed sealants, corrosion or other deterioration. Green N Clean is not responsible for pre-existing deterioration or failure of compromised materials.

Plants and Property 

Reasonable care will be taken around plants and property. The Client must identify delicate or valuable plants, electrical equipment, alarms, cameras, speakers, solar equipment and other vulnerable items. 

Result 

Cleaning does not guarantee removal of every stain, oxidation mark, mould spot, lichen patch, rust stain, paint defect or permanent discolouration. 

SERVICE 2 — ROOF CLEANING / MOSS, MOULD & LICHEN TREATMENT 

Nature of Service 

Roof treatment is a cleaning and maintenance service only. It is not a roof repair, structural inspection, roofing certification or weathertightness assessment. 

Roof Condition 

Roofs may contain brittle tiles, corrosion, cracks, failed flashings, defective fixings, fragile skylights, hidden leaks or concealed deterioration. Green N Clean may refuse or stop work where safe access cannot reasonably be established. 

Existing Damage 

Cleaning or treatment may reveal deterioration or failure of aged materials. Green N Clean is not responsible for pre-existing roof defects, subject to mandatory legal rights. 

Treatment Result 

Moss, mould and lichen may not disappear immediately. Weather and roof condition affect results. Treatment does not guarantee permanent prevention of regrowth or repair of leaks. 

Access and Weather 

Ladders, EWP/MEWP, cherry-picker or other specialist access may be required. Wind, rain, lightning or slippery conditions may require postponement. 

SERVICE 3 — GUTTER CLEANING 

Scope 

Gutter cleaning covers the gutters specifically listed. Unless quoted, it excludes roof repair, downpipe replacement, underground stormwater clearing, fascia/soffit repair and leak repair.

Fragile Guttering 

Old, corroded or poorly supported gutters can fail during access or cleaning. Green N Clean is not responsible for pre-existing cracks, rust, failed brackets, deteriorated fascia, failed joints or defective drainage systems. 

Downpipes and Drainage

Removing debris from gutters does not guarantee underground stormwater systems are clear. Additional work may be required for blocked downpipes or drainage 

SERVICE 4 — DECK / TIMBER CLEANING 

Condition 

Timber may contain rot, weak boards, loose fixings, previous coating failure, structural weakness or water damage. 

Cleaning Effect 

Pressure or chemical cleaning may remove coatings, expose deterioration or alter colour. Weathered timber may not clean uniformly. 

Exclusions 

Structural repairs, sanding, staining, oiling, painting and waterproofing are excluded unless specifically quoted. 

SERVICE 5 — GARDENS / LAWNS / HEDGE TRIMMING 

Scope and Preparation 

Only the gardening, lawn or hedge work listed in the quotation is included. The Client must remove pet waste, toys, hoses, ornaments, vehicles and other obstructions. 

Hidden Services 

The Client must identify irrigation, cables, pipes, drains and underground services where known. Green N Clean is not responsible for concealed or incorrectly identified services, subject to mandatory legal rights. 

Hedges

The Client should specify desired height, width and shape before work. Regrowth and uniformity cannot be guaranteed. 

Garden Debris 

Gardening may move or spread leaves, grass, branches and other debris. The Client should protect or remove vulnerable surrounding items unless disposal or protection is included. Excess Debris Excessive green waste, rubbish or debris removal is the Client’s responsibility unless specifically agreed and quoted. 

SERVICE 6 — TREE TRIMMING 

Scope 

Only the tree work specifically quoted is included. 

Client Disclosure

The Client must identify protected, native, significant or otherwise restricted trees and disclose relevant council requirements unless Green N Clean has expressly agreed to manage approvals. 

Specialist Work

Tree work does not include arborist certification, structural tree assessment, tree removal, stump grinding, root removal, power-line isolation or council consent unless specifically quoted.

Hidden Hazards

Trees may contain nests, wires, wildlife, hidden supports, decay or other hazards. Work may be stopped where unsafe. 

Property Protection 

Reasonable care will be taken, but falling branches and access equipment may affect surrounding surfaces, landscaping or property. Pre-existing weakness and concealed hazards remain a risk to the extent permitted by law 

SERVICE 7 — PEST CONTROL 

Scope

Treatment is limited to the pests, areas, methods and follow-up visits stated in the quotation. No Permanent Guarantee Pest control does not guarantee permanent elimination or prevention. Results depend on building condition, hygiene, food sources, harbourage, neighbouring properties, weather, breeding cycles and Client compliance. 

Inspection Limits 

Unless expressly quoted, inspection is visual and limited to reasonably accessible areas. Furniture, walls, ceilings, cavities and stored items may conceal pests. 

Client Responsibilities 

The Client must follow preparation, treatment, ventilation, re-entry and follow-up recommendations and disclose children, pets, aquariums, livestock, beehives and relevant hazards. 

Bait Stations 

Green N Clean-owned bait stations must not be moved, opened or tampered with. 

Treatment Products 

Products are used in accordance with applicable labels, controls and safety requirements. Green N Clean may refuse treatment where safe application cannot reasonably be achieved. 

SERVICE 8 — INTERIOR CLEANING 

Preparation

The Client must remove or secure valuable, fragile, sentimental and unstable items. Green N Clean is not responsible for items left in work areas where reasonable protection could not be provided. 

Surfaces 

Commercial cleaning products and processes may expose weak paint, plasterboard, flooring, silicone, coatings, mould, water damage or other pre-existing conditions. 

Stains and Damage 

Cleaning does not guarantee removal of every stain, mark, odour or defect. Some surfaces may have permanent staining or deterioration. 

Access 

Areas that cannot be safely or reasonably accessed may be excluded from the service 

SERVICE 9 — CARPET CLEANING 

Preparation 

The Client should pre-vacuum where possible and identify stains, urine contamination, delicate fibres, previous chemical treatment and problem areas. 

Stain Removal 

Carpet cleaning does not guarantee removal of every stain or odour. Permanent staining, fibre damage, fading, burns, urine damage, delamination and previous chemical damage may remain or become more visible. 

Drying 

Reasonable ventilation is required after extraction. Drying times vary with carpet construction, underlay, humidity, ventilation and building conditions. 

Furniture 

Furniture is moved only where agreed. Fragile, defective or unsuitable furniture may not be moved. 

SERVICE 10 — MOULD CLEANING / REMEDIATION

Scope 

Visible mould cleaning and full mould remediation are different services. The quotation will state which service is being provided. 

Underlying Moisture 

Mould may return if leaks, condensation, ventilation problems, water ingress, building defects or other moisture sources remain. 

Moisture Assessment 

Moisture readings are point-in-time observations and do not guarantee that all concealed moisture or mould has been identified. 

Materials 

Porous materials may require removal or specialist treatment. Containment, HEPA filtration, disposal and specialist remediation controls are included only where quoted.

Limitations 

Green N Clean does not provide structural, engineering, building or environmental certification unless expressly quoted 

SERVICE 11 — FLOOD / WATER DAMAGE RESTORATION 

Our Role 

Green N Clean’s flood and water-damage service is primarily water extraction, damage mitigation, structural drying and moisture monitoring. Unless specifically stated in writing, Green N Clean is not the building contractor responsible for repairing, rebuilding, replacing, reinstating or certifying the property. 

Builder Repairs 

Repairs and reinstatement such as plasterboard, insulation, flooring, skirting, cabinetry, painting, plastering, electrical work, plumbing, framing, structural repairs, waterproofing, roofing and building envelope repairs are excluded unless separately quoted and legally permitted. These works should be undertaken by an appropriately qualified builder or specialist. 

Water Source 

The Client is responsible for stopping or arranging for the water source to be stopped unless this is specifically included. Green N Clean does not warrant that the source of water ingress has been identified and does not provide plumbing, roofing, drainage or building-envelope diagnosis unless quoted. 

Hidden Damage 

Flooding can cause concealed damage to wall cavities, framing, insulation, flooring, subfloors, cabinetry, skirting, ceilings, electrical systems, plumbing, adhesives, timber and structural components. Visual inspection and moisture readings are not structural, engineering, electrical, plumbing or invasive investigations. 

Moisture Readings 

Moisture readings are taken at particular locations and times. They do not guarantee that all concealed or inaccessible moisture has been identified. Green N Clean does not guarantee a particular drying time or outcome. 

Drying Equipment 

Air movers, dehumidifiers, extraction equipment, moisture meters, thermal imaging and other equipment may be used. Equipment remains Green N Clean’s property unless agreed otherwise. The Client must not move, disconnect or interfere with equipment. 

Damaged Materials 

Removal of carpets, underlay, loose materials or other damaged items is included only where quoted. Removal of wall linings, ceilings, insulation, flooring systems or other building materials may require a builder or licensed building practitioner. 

Mould and Secondary Damage 

Drying reduces moisture-related risk but does not guarantee that mould or further deterioration will not occur. Mould may return where the underlying moisture source, leak, condensation, ventilation problem or building defect remains. 

Contaminated Water 

Flood water may contain sewage, bacteria, chemicals, hydrocarbons, animal waste, sharps or other contaminants. Specialist biohazard or hazardous-substance remediation is excluded unless specifically quoted. 

Contents 

Unless specifically included, flood drying does not include restoration of furniture, electronics, documents, valuables or other contents. Water-damaged contents may require separate specialist restoration. 

Insurance 

Green N Clean may provide photographs, moisture records, equipment records and drying reports within the agreed scope. Green N Clean does not determine insurance coverage or settlement. The Client remains responsible for Green N Clean’s invoice unless expressly agreed otherwise in writing. 

Drying Does Not Mean Repair 

Completion of drying does not mean the property has been repaired or restored. The Client may need a builder, engineer, electrician, plumber or other specialist. Green N Clean does not certify that the building is structurally sound, safe for permanent occupation, Building Code compliant or suitable for reinstatement. 

Further Damage 

Green N Clean will take reasonable steps within the agreed scope to mitigate further damage but cannot guarantee that further deterioration will not occur due to delayed attendance, ongoing water ingress, concealed moisture, inaccessible areas, humidity, power interruption, Client interference, pre-existing defects, weather or circumstances outside our reasonable control. 

SERVICE 12 — FIRE & SMOKE RESTORATION 

Scope 

Fire and smoke restoration may include emergency attendance, soot and smoke residue cleaning, odour treatment, contents cleaning, deodorisation, salvage handling, waste removal and restoration activities only to the extent stated in the quotation. 

Safe Site 

Green N Clean will not enter or commence restoration in an unsafe or restricted fire-damaged area. The responsible party must ensure the site is released for contractors and unsafe areas are identified. 

Exclusions 

Fire restoration cleaning is not structural engineering, electrical certification, building certification, fire investigation, cause determination or hazardous-material certification unless expressly quoted and performed by an appropriately qualified person. 

Soot and Smoke 

Green N Clean will use reasonable care and commercially reasonable efforts to remove soot, smoke residue, staining and odour within the agreed scope. However, soot, smoke, heat and chemical residue can permanently damage paint, plasterboard, ceilings, timber, cabinetry, flooring, insulation, fabrics and other porous materials. 

Painting / Replacement 

Where cleaning cannot reasonably restore a painted or finished surface because soot, smoke, heat or fire damage has permanently affected the substrate or coating, repainting, sealing, replacement or other building restoration may be required. Such work is outside the cleaning scope unless specifically quoted. 

Odour 

Odour treatment may reduce smoke and fire-related odours but does not guarantee permanent elimination where contamination remains in concealed materials or affected materials cannot reasonably be restored. 

Contents 

Contents restoration is subject to condition, contamination, compatibility, access and agreed scope. Some items may be unsalvageable. Green N Clean does not guarantee restoration of any particular item. Secondary Water Damage Firefighting water may create additional moisture damage or mould risk and may require separate flood/restoration services. 

Hazards 

Fire-damaged properties may contain unstable structures, damaged electrical systems, asbestos, chemicals, soot residues or other hazards. Green N Clean may stop work immediately if a hazard is identified. 

Insurance 

The Client remains responsible for Green N Clean’s charges unless a written alternative insurance arrangement is agreed. Green N Clean does not guarantee insurer approval or reimbursement. 

SERVICE 13 — CRIME / TRAUMA / BIOHAZARD CLEANING 

Scene Release 

Green N Clean will not enter or clean an active or restricted crime scene until the relevant authority or responsible person has released the area. 

Scope 

Cleaning and decontamination are limited to the agreed scope and conditions where appropriate controls can be established. 

Forensic Limitation 

Green N Clean does not investigate incidents, determine cause, collect forensic evidence, provide forensic opinions or certify a scene unless separately authorised and appropriately qualified. 

Unknown Hazards 

Unknown sharps, drugs, chemicals, biological hazards, asbestos or structural instability may require specialist assessment and immediate stop-work. 

Contamination 

Visible cleaning does not guarantee that all concealed contamination has been identified or removed. 

Waste 

Contaminated materials and waste will be handled and disposed of according to applicable requirements and the agreed scope. Specialist disposal may incur additional charges. 

SERVICE 14 — ASBESTOS & SUSPECTED ASBESTOS — STRICT NO-WORK POLICY 

No Asbestos Work

GREEN N CLEAN DOES NOT WASH, WATERBLAST, CLEAN, TREAT, SCRAPE, SAND, BRUSH, DRILL, REMOVE OR OTHERWISE DISTURB ANY SURFACE OR MATERIAL KNOWN OR REASONABLY SUSPECTED TO CONTAIN ASBESTOS. 

Immediate Stop-Work 

If asbestos or suspected asbestos is identified before or during work, Green N Clean will immediately stop work in the affected area and will not continue that work. 

Client Disclosure 

The Client must disclose known or suspected asbestos before work commences, including asbestos containing roofing, cladding, soffits, gutters, fencing, walls, flooring or other materials.

Undisclosed Asbestos 

Where asbestos or suspected asbestos has not been disclosed to Green N Clean and is subsequently disturbed or damaged during work, Green N Clean accepts no responsibility for the consequences of that undisclosed asbestos condition, including pre-existing deterioration, fibre release or contamination, to the extent permitted by law. 

Pre-existing Asbestos Damage 

Green N Clean accepts no responsibility for pre-existing damage, deterioration, contamination, breakage, cracking or fibre release arising from age, weathering, corrosion, previous work, poor maintenance, building movement, impact, third parties or other conditions outside our control, subject to mandatory legal rights. 

No Asbestos Survey or Removal 

Green N Clean does not provide asbestos surveying, asbestos removal or asbestos clearance certification unless expressly stated in writing and undertaken under applicable legal and safety requirements. 

Further Work 

If asbestos or suspected asbestos is identified, the Client may be required to engage a competent asbestos professional or licensed asbestos removalist before any further work can be considered. 

Costs 

Reasonable additional costs caused by asbestos-related delay, specialist assessment, controls, cancellation or return attendance may be charged where permitted. 

Important Limitation 

Nothing in this section excludes or limits any duty or liability that cannot legally be excluded. 

QUOTE-LEVEL SERVICE WARNINGS 

ASBESTOS

GREEN N CLEAN DOES NOT WASH OR DISTURB ASBESTOS OR SUSPECTED ASBESTOS CONTAINING MATERIALS. IF ASBESTOS OR SUSPECTED ASBESTOS IS IDENTIFIED, WORK WILL STOP IMMEDIATELY IN THE AFFECTED AREA. 

FLOOD / WATER DAMAGE 

OUR PRIMARY ROLE IS WATER EXTRACTION, STRUCTURAL DRYING AND MOISTURE MONITORING. BUILDING REPAIRS, REINSTATEMENT AND REPLACEMENT OF DAMAGED MATERIALS ARE EXCLUDED UNLESS SPECIFICALLY QUOTED AND SHOULD BE UNDERTAKEN BY AN APPROPRIATELY QUALIFIED BUILDER OR SPECIALIST. 

FIRE / SMOKE

WE WILL USE REASONABLE CARE AND COMMERCIALLY REASONABLE EFFORTS TO CLEAN SOOT, SMOKE RESIDUE AND ODOUR. WHERE SOOT, SMOKE OR HEAT HAS PERMANENTLY DAMAGED PAINT OR OTHER SURFACES, PAINTING, SEALING, REPLACEMENT OR OTHER BUILDING RESTORATION MAY BE REQUIRED AND IS NOT INCLUDED UNLESS QUOTED. 

ROOF 

ROOF TREATMENT IS A CLEANING/MAINTENANCE SERVICE, NOT A ROOF REPAIR, STRUCTURAL INSPECTION OR WEATHERTIGHTNESS CERTIFICATION. 

PEST CONTROL 

PEST CONTROL DOES NOT GUARANTEE PERMANENT ELIMINATION. CLIENT MUST FOLLOW PREPARATION, RE-ENTRY AND FOLLOW-UP RECOMMENDATIONS. 

EXTERIOR WASH 

CLIENT MUST CLOSE WINDOWS/DOORS AND DISCLOSE KNOWN LEAKS OR WEATHER TIGHTNESS DEFECTS.
